Health and Safety Briefing - Waiver

Modern Combat Academy (“Modern Combat Academy, We, Us or Our”) is a full-service mixed martial arts academy offering instruction in Brazilian Jiu-Jitsu, Kickboxing, MMA, Boxing, Wrestling, Judo, and Muay Thai, as well as supplementary fitness programs to support your training (together, “Mixed Martial Arts”).

Mixed Martial Arts is a dangerous recreational activity that poses a significant risk of physical, economic, and emotional harm to participants. Gymnasiums such as ours can also present other risks, such as slipping on floors, colliding with equipment and other members, and being injured while using exercise equipment.

Combat sports such as those offered by Modern Combat Academy and exercise in general present obvious risks, including (but not limited to):

• Soft tissue injuries;
• Joint injuries;
• Broken bones;
• Concussion.
• Brain Damage
• Paralysis and partial paralysis; and
• Permanent disability
• Death.

Furthermore, the subsequent economic impact on the participant, which can be prolonged or lifelong, is consequential to these physical risks.

To minimise these risks, it is a condition of all participants' memberships (including parents or guardians who have authorized their child to participate in Mixed Martial Arts at Modern Combat Academy) (“You or Your”) that You follow all directions given to You by Modern Combat Academy instructors and employees at all times.

The instructors and management at Modern Combat Academy are committed to ensuring that all classes are conducted safely, but Modern Combat Academy cannot guarantee that you will not sustain injury. You acknowledge this and agree that:

a. You train at Modern Combat Academy at Your own risk;

b. To the maximum extent permissible under law, You release Modern Combat Academy and its officers, servants, agents, employees, and instructors from all liability for all loss, damage, or injury You sustain, even if that loss, damage, or injury is caused by Our negligent, grossly negligent, or willful act as well as breach of contract; and

c. To the maximum extent permissible under law, You indemnify Modern Combat Academy and its officers, servants, agents, employees, and instructors against all liability for all loss, damage, or injury you sustain, even if that loss, damage, or injury is caused by our negligent, grossly negligent, or willful act as well as breach of contract.

By signing below, you acknowledge that you have read and understood this Agreement and the Important Information on this page. You further acknowledge that you agree to the terms and conditions set out in this Agreement and the Important Information on this page.

Modern Combat Academy (“Modern Combat Academy, We, Us or Our”) is a full-service mixed martial arts academy offering instruction in Brazilian Jiu-Jitsu, Kickboxing, MMA, Boxing, Wrestling, Judo, and Muay Thai, as well as supplementary fitness programs to support your training (together, “Mixed Martial Arts”).

Members (including parents or guardians who have authorized their child to participate in Mixed Martial Arts at Modern Combat Academy) (“You or Your”)

Please answer Yes or No to the following questions.

Do you have a history of respiration conditions, such as asthma?             

Do you have a history of epilepsy?

Do you have any allergies? If Yes, and Serious, we strongly suggest having a detailed conversation with us to help us understand your needs                                                 

Do you have a history of Cardiac/heart disease or high blood pressure?     

Do you have any other medical/pre-existing conditions not listed above?                     

If Yes, please provide relevant details

PLEASE NOTE: Regardless of any current conditions. Modern Combat Academy strongly recommends that you or on behalf of your child seek medical advice before beginning training or any exercise program which may or may not be associated with Mixed Martial Arts. You or on behalf of your child acknowledge that you or your child are fit to participate in activities held by Modern Combat Academy safely.

If you have answered Yes to any of the above to by signing below, you acknowledge you have the 
ability to manage your own conditions should you proceed to participate in Mixed Martial Arts at Modern Combat Academy 

Before You begin participating in Mixed Martial Arts

Modern Combat Academy (“Modern Combat Academy, We, Us or Our”) is a full-service mixed martial arts academy offering instruction in Brazilian Jiu-Jitsu, Kickboxing, MMA, Boxing, Wrestling, Judo, and Muay Thai, as well as supplementary fitness programs to support your training (together, “Mixed Martial Arts”).

Members (including parents or guardians who have authorised their child to participate in Mixed Martial Arts at Modern Combat Academy) (“You or Your”)

a. You agree to complete the health questionnaire included in this Agreement and to accurately report all health matters that may affect Your ability to train safely.

b. You agree to provide Us with updated health information if Your health deteriorates or changes adversely.

c. You acknowledge the likelihood of a physical/health condition You may have of which You are not aware may be aggravated or worsened by participation in Modern Combat Academy.

d. Modern Combat Academy strongly recommends You:

I. seek your own independent medical advice before commencing training at Modern Combat Academy; and

II. Seek medical advice if You become concerned about Your health at any point during Your Membership.

e. You agree to follow Modern Combat Academy instructions regarding the use of protective equipment as instructed, including but not limited to:

·       Mandatory use of mouthguards at all times

·       Shin Pads

·       Head Gear

·       Groin Guards

·       No Jewelry to be worn during martial arts activities 

Failure to do so may result in an inability to participate in class and/or the termination of Your membership.

f. You agree to always follow the instructions of Modern Combat Academy instructors while within Modern Combat Academy facility.

g. Should an incident/injury occur, you agree to promptly report the injury at the time it happens and participate in the Modern Combat Academy Incident Reporting process.

Emergency Medical Assistance

a. In the event of an emergency, You acknowledge and agree that We may administer all necessary first aid and call emergency services on Your behalf.

I. You acknowledge and accept that there may be no or inadequate facilities for transport or treatment.

b. You agree to reimburse Us all costs associated with emergency services called on Your behalf.

If, because of any religious objection to emergency or medical treatment, You do not want Us to treat Your injuries, You must:

I. notify Us as soon as possible of this;

II. at the same time, provide Us with written instructions informing Us how You would like Us to deal with Your injury and who You want Us to contact; and

III. if You are injured, tell Us (if You are able), that You have an objection to medical treatment, and We have Your instructions.

Photography Release

You acknowledge that when in the gym, media may be created for advertisement and social media use. You acknowledge and authorise your likeness and make no claim to any copyright of these images/videos.
